1. Scope and Acceptance
These Terms & Conditions / User Agreement (the «Agreement») govern access to and use of the online transcription, audio/video processing, speech-to-text and related digital services available through trcription.com (the «Service»). The document applies to all visitors, registered users and customers of trcription.com.
By accessing the website, creating an account, uploading content, purchasing tokens, placing an order or otherwise using the Service, the user confirms that they have read, understood and agreed to this Agreement and all policies referenced herein, including the Payment & Refund Policy and Privacy Policy.
If the user does not agree with this Agreement, the user must not access or use the Service.
2. Service Description
The Service provides digital tools for uploading audio, video, text or other supported files and generating transcriptions, captions, summaries or other automated outputs using software and artificial intelligence technologies.
The exact list of functions, supported formats, limits, processing speed, languages, tariffs and available plans may be displayed on the website interface and may be changed from time to time.
The Service is provided as a digital online service. The Operator does not guarantee that the generated result will be error-free, legally sufficient, fully accurate, suitable for a specific purpose or compliant with specialized industry requirements without user review.
3. Eligibility and Age Restrictions
The Service is available only to users who are at least 18 years old or have reached the age of legal majority in their jurisdiction, whichever is higher.
By using the Service, the user represents that they have full legal capacity to enter into this Agreement. If the user acts on behalf of a company or other legal entity, the user confirms that they are authorized to bind that entity to this Agreement.
The Operator may refuse registration, suspend access or request additional verification where legally required or where there are reasonable grounds to believe that the user does not meet eligibility requirements.
4. Account Registration and Security
Certain functions may require account registration. The user must provide accurate, current and complete information and must keep such information up to date.
The user is responsible for maintaining the confidentiality of login credentials, passwords, tokens, API keys and account access devices. All activity performed through the account is deemed to be performed by the user unless proven otherwise.
The user must immediately notify the support team at info@trcription.com of any suspected unauthorized access, credential compromise or security incident.
5. User Content and Rights to Outputs
The user retains all rights to the audio, video, text, documents and other materials uploaded by the user to the Service («User Content»), subject to the rights granted to the Operator for operating the Service.
The user grants the Operator a limited, non-exclusive, worldwide, revocable where technically possible, royalty-free license to host, transmit, process, convert and analyze User Content solely for the purpose of providing the Service, maintaining security, troubleshooting and complying with applicable law.
Unless expressly stated otherwise in a separate agreement or applicable plan, the user may use generated outputs for lawful personal or commercial purposes, including internal business use, websites, advertising materials, YouTube, podcasts, games, training materials and other media, provided that such use does not violate third-party rights, applicable law or this Agreement.
The user is solely responsible for ensuring that they have all rights, permissions and lawful bases necessary to upload the source content and use the resulting output, including rights in recordings, voices, music, scripts, interviews, personal data and confidential information.
6. Prohibited Use
The user must not use the Service to upload, process, generate, distribute or facilitate content or activities that are illegal, harmful, deceptive, abusive or infringe third-party rights.
- content that infringes copyrights, trademarks, publicity rights, privacy rights or contractual obligations;
- content involving unlawful surveillance, unauthorized recording, doxxing, identity theft or misuse of personal data;
- content that promotes violence, terrorism, extremism, hate, harassment, discrimination or threats;
- content involving child sexual abuse material, sexual exploitation of minors or any unlawful sexual content;
- content intended to defraud, impersonate, mislead, manipulate public opinion through deception or bypass security systems;
- attempts to reverse engineer, overload, scrape, resell access to, interfere with or compromise the Service;
- use of the Service in violation of sanctions, export controls, anti-money laundering rules or prohibited jurisdiction restrictions.
The Operator may remove content, suspend processing, limit functions, terminate access and preserve relevant records where necessary to protect the Service, users, third parties or comply with law.
7. Voice, Audio and Sensitive Content Restrictions
The user must not upload or process voice recordings, interviews, calls or other personal audio unless the user has a lawful basis and all required consents or permissions.
If any voice cloning, voice identification, speaker diarization or similar functionality is offered, such functionality may be subject to additional restrictions. The user must not use the Service to impersonate a person, create misleading audio, violate publicity rights or misrepresent the origin of generated content.
The user must not upload special categories of personal data, medical information, financial secrets, passwords, government identifiers or confidential third-party data unless the user is legally entitled to do so and accepts the related risks.
8. Payments, Tokens and Digital Credits
Access to certain functions may require purchase of tokens, credits, subscription plans or paid service packages. Payment terms, available packages, prices, currencies and usage limits are displayed in the Service interface or in the Payment & Refund Policy.
Tokens and credits are technical accounting units used only within the Service. They are not electronic money, stored value, securities, legal tender or financial instruments and cannot be exchanged for cash except where expressly required by applicable law or this Agreement.
Tokens may be deducted for actual processing attempts, including failed or incomplete attempts caused by incorrect files, unsupported formats, user-side errors, insufficient input quality, repeated submissions or violation of technical requirements.
9. Availability and Service Limitations
The Operator uses commercially reasonable efforts to keep the Service available; however, the Service may be temporarily unavailable due to maintenance, updates, outages, third-party provider failures, payment processing issues, security incidents, force majeure or circumstances outside the Operator’s reasonable control.
Processing time and output quality may depend on file size, audio quality, language, background noise, speaker overlap, system load, third-party models, network connectivity and selected plan.
The Operator may introduce, modify or remove features, limits, file formats, languages, prices or technical requirements where necessary for security, operational, legal or business reasons.
10. User Responsibility and Review of Outputs
The user must independently review, verify and edit all generated outputs before relying on them, publishing them, using them in legal, medical, financial, employment, compliance or other sensitive contexts.
The Service is not a substitute for professional advice, certified transcription, legal review, medical review, accounting advice or other regulated services.
The user is responsible for all decisions, publications, communications and actions based on outputs generated through the Service.
11. Intellectual Property of the Service
All rights in the website, software, interface, design, databases, models, documentation, trademarks, logos, domain names and other elements of the Service belong to the Operator or its licensors.
The user receives a limited, revocable, non-exclusive, non-transferable right to access and use the Service in accordance with this Agreement. No rights are granted except as expressly stated herein.
12. Third-Party Services
The Service may rely on hosting providers, payment providers, analytics tools, email services, AI model providers, security tools and other third-party services. The Operator is not responsible for third-party terms, outages, delays or errors outside its reasonable control.
Payment processing may be carried out by an external payment provider. The Operator does not store full bank card numbers, CVV codes or other complete card credentials.
13. Suspension and Termination
The Operator may suspend or terminate the user’s access where the user violates this Agreement, creates security risks, causes harm to other users or the Service, submits unlawful content, fails to pay, initiates abusive disputes or where required by law.
The user may stop using the Service at any time and may request account deletion in accordance with the Privacy Policy. Termination does not affect accrued payment obligations, lawful record retention or provisions intended to survive termination.
14. Changes to the Agreement
The Operator may update this Agreement from time to time. The updated version will be published on the website with the updated date. Where required by law or where changes are material, the Operator may provide additional notice through the website interface or by email.
Continued use of the Service after the effective date of an updated Agreement constitutes acceptance of the updated terms.
15. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. The Operator does not guarantee uninterrupted availability, absolute accuracy, fitness for a particular purpose, error-free outputs or compatibility with every device, file or workflow.
The Operator shall not be liable for indirect, incidental, consequential, special or punitive damages, loss of profits, loss of data, reputational harm or business interruption arising from use of the Service, except where such limitation is prohibited by applicable law.
16. Governing Law and Dispute Resolution
Unless mandatory consumer protection laws provide otherwise, this Agreement is governed by the laws applicable to the Operator’s registered jurisdiction. Where the Operator identifies Luxembourg as its registered jurisdiction on the website, the Agreement may be interpreted under the laws of Luxembourg, subject to mandatory rules applicable to consumers.
